Personally, I'm for getting the government out of the 'marriage' business altogether. Common law 'estate' ownership issues can be ironed out with 'incorporation' like documents for any two people (or three, or 5...) and the term 'marriage' can be left to the realm of whatever 'spiritual' community the people want to draw upon. Maybe the 'incorporation' document would still need 'two witnesses' and an official of some sort, for it to be valid. But basically, logically, polygamy would have to be made legal also. One man, 10 women, and one woman with 10 men. Each would have to be made legal. But should there be a limit on the number of wives, or husbands, that one can have? Should 5 women be able to 'incorporate' themselves with 5 men? With all of them sharing everything, including parenting? How do you sort out parenting rights in that situation? Especially if one partner wants a divorce from the other 9? What about 100 people married to each other, and there are 5 different theoretical types of perceived genders involved?
So I suppose 'marriage' could just become a synonym for 'Commune' or 'Domestic Corporation'? I suppose the Domestic Corporation of 5 (or 17) people would be a 'non-profit' Corporation? I suppose, theoretically, any group of people could create for themselves a 'Domestic Corporation' of their own at any time right now. And I suppose, legally, those 5 (or 17) people could give the legal name of "Marriage of X,Y,Z" to that corporation, or LLC. And the government would be fine with it. Problem solved... ?? At least is seems that adults would have a lot more 'liberty' in their personal affairs, but what about the children involved, would they have more, or less, liberty while growing up in a 'Domestic Corporation'? Maybe we should take Hillary's idea about "It takes a Village" and make it a legal construct. Is having multiple step-fathers, and step-mothers a good thing? Maybe if they all live together simultaneously? What do you think
